Terms and conditions


These Terms and Conditions (“Terms”) will govern your membership of the customer loyalty programme for Hede Fashion Outlet (the “Centre”) named the “Hede Fashion Club Programme” (the “Programme”). The Programme enables you to receive benefits, discounts and special offers from retailers of the Centre participating in the Programme (the “Participating Retailers”).
These Terms will also govern the use of your Hede Fashion Club card or app (the “HFC Card/App”). Use of your HFC Card/App constitutes acceptance of these Terms, including acceptance of the Privacy Policy (section 4).
These Terms can be consulted at any time at www.hedefashionoutlet.se or can be obtained at the information centre of the Centre (the “Information Centre”).
The Programme is operated and provided to you by Hede Fashion Outlet AB, (Business Identification Number 556575-4750) with its registered office at Kungsparksvägen 80 434 39 Kungsbacka (jointly referred to as “we”, “us”, “our”).

1. The Programme

1.1. Overview
The Programme enables you, by means of your HFC Card/App, to save 5% of the value of the transactions that you carry out at Participating Retailers’ stores of the Centre, and to spend this saved value (the “Loyalty Swedish Kronor” or “Loyalty Kronor”) at the Participating Retailers’ stores of the Centre (excluding any other stores or shopping centres), with a maximum of 25% of the value of your transaction (save as provided for below).
In addition, Participating Retailers’ stores in the Centre may propose benefits, discounts and special offers for the members of the Programme (the “Offers”).
Please be aware that certain Participating Retailers will only participate in the Programme in relation to Offers and not with respect to the Loyalty Kronor. Therefore, the saving and redemption of Loyalty Kronor will not be possible at the Centre stores of those Participating Retailers (this mainly applies to food and beverage operators, and pop-up stores).
1.2. Participating Retailers
A list of the Participating Retailers in the Centre is available at www.hedefashionoutlet.se, where it will be indicated whether a particular Participating Retailer participates in the Programme with respect to both Loyalty Kronor and Offers or only with respect to Offers.
The list of Participating Retailers may change from time to time. Not all retailers within the Centre will be part of the Programme.
1.3. Loyalty Kronor
(i) Saving Loyalty Kronor
For every purchase at a Participating Retailers’ store of the Centre, you will receive Loyalty Kronor worth 5% of the value (including VAT) of your purchase.
Loyalty Kroner cannot be collected on pharmaceuticals, alcohol, tobacco, lottery tickets or gift cards.
In no case will Loyalty Kronor be redeemable for money.
Loyalty Kronor shall be awarded to you upon presentation of your HFC Card/App. You may have Loyalty Kronor saved on your HFC Card/App in a Participating Retailer’s store of the Centre up to 14 days after a purchase, upon production of the original cash register receipt.
The Loyalty Kronor status provided by us shall be binding upon all parties involved.
If no activity takes place with your HFC Card/App during a 12 months’ period (savings or redemption of Loyalty Kronor), your HFC Card/App will be blocked and your Loyalty Kronor will be lost.
If you return goods for any reason, you will keep the Loyalty Kronor saved as a consequence of the relevant purchase transaction.
(ii) Redeeming Loyalty Kronor
Loyalty Kronor can be redeemed at the Participating Retailers’ stores of the Centre (excluding any other stores or shopping centres) with a maximum of 25% of the value of your purchase (including VAT). There is no limit to the number of times you can redeem with your HFC Card/App. You can only redeem Loyalty Kronor with your personal HFC Card/App.
Exceptionally, redemption may not be possible in case of special promotions or goods offered at lower prices than the outlet price. This shall be clearly communicated by the Participating Retailer.
Loyalty Kronor cannot be used on pharmaceuticals, alcohol, tobacco, lottery tickets or gift cards.
Loyalty Kronor’s cannot be converted into money or cashed otherwise. 
When you return (for any reason) goods which have been partially paid with Loyalty Kronor, no restitution of Loyalty Kronor will be made. Additionally, the returns policy of the Participating Retailer shall apply.
1.4. Offers
(i) Overview
The Participating Retailers’ stores of the Centre may propose Offers. The Offers you have access to may vary from time to time.
Offers will be subject to availability, and published Offers will be subject to terms and conditions imposed by the offering Participating Retailer (for example, closing dates and exclusions). It may also be necessary for our Participating Retailers to make changes to Offers which have already been published.
From time to time, it may be necessary to withdraw Offers from the Programme. It may not always be possible to give advance warning of this.
As far as possible, any relevant terms and conditions and/or details of limits on availability will be provided alongside the Offer. To avoid disappointment, you are invited to read the Offer carefully before trying to redeem an Offer.
Details of Offers available to you will be shown on the HFC App, and in emails which will be sent to you about the Programme.
(ii) Redemption of the Offers
To redeem an Offer, you shall present to the offering Participating Retailer the unique bar code on your HFC Card/App or the e mail where the Offer was communicated to you.
Exceptionally, redemption may not be possible in case of special promotions or goods offered at lower prices than the outlet price. This shall be clearly communicated by the Participating Retailer.
Loyalty Kroner cannot be used on pharmaceuticals, alcohol, tobacco, lottery tickets or gift cards.
You may be prevented from redeeming an Offer if (i) the Participating Retailer has reasons to suspect fraud or misconduct on your part or in the way the Offer is being used or (ii) the Offer was sent to you in error due to a technical fault.

2. Membership of the Programme

2.1. Joining the Programme
Every natural person older than 18 years can apply for Programme membership.
To join the Programme, you shall apply for membership via the the Centre’s website, the HFC App, at the Information Center, or at Participating Retailers’ stores of the Centre.
If you register for membership at Participating Retailers’ stores, you will be required to register with your full name, email, country of residence and language.
If you register for membership via the HFC App, the Centre’s website or the Information Centre, you will be required to register with your full name and address, country of residence and language.
These personal details are necessary to keep you informed and to return your HFC Card (in case of loss) in the Centre. Please read our Privacy Policy below to learn how this information is used.
The HFC App is free to download, but downloading the mobile application may incur standard data download rates. Please contact your telecom service provider for more details.
Membership of the Programme is free for you and involves no obligation to buy any products or services whatsoever.
2.2. End of your membership and cancellation of the Programme
Your membership of the Programme will have no time-limit. You will be able to cancel your membership at any time, by simply deleting or ceasing to use the HFC Card/App or emails containing Offers, or by letting us know using any of the contact means set forth below in Section 6, with immediate effect. You will not be charged any cancellation fee or any other fee, penalty or other amount as a result of such cancellation.
We reserve the right to terminate or suspend the Programme at any time at our discretion and without reason, in which case we will let you know at least 2 months in advance.
We reserve the right to terminate your membership of the Programme at our discretion in the event that: (i) we terminate the Programme; or (ii) we reasonably believe that you have failed to comply with these Terms; or (iii) we reasonably believe you have behaved in a way which is fraudulent, inappropriate or illegal.
We reserve the right to terminate your membership of the Programme if you do not redeem Offers or Loyalty Kronor for a continuous period of 12 months.
Where your membership of the Programme is terminated then from the date of termination you will not be able to redeem Offers or Loyalty Kronor.

3. Our Responsibilities and Liability

The HFC Card/App are strictly personal, not transferable and can only be used for private use. We will not assume any responsibility or liability for: (i) the Offers made by Participating Retailers; (ii) failure of a Participating Retailer to honour an Offer; or (iii) any goods or services which you purchase from a Participating Retailer using an Offer, Loyalty Kronor, or otherwise.
If an issue arises in relation to any of the matters listed above, you should contact the Participating Retailer directly to resolve it.
Whilst we will try to ensure that the scanners and system to save and redeem Loyalty Kronor and redeem Offers are available during store opening hours, you understand that there may be circumstances where the scanner and/or system is unavailable and you will not be able to save or redeem Loyalty Kronor or redeem Offers. To the maximum extent permitted by law, we accept no liability for any loss or damage suffered by you in connection with using the Programme, including without limitation, in relation to any transmission delays, failures of the HFC Card/App, damage to any mobile phone, data message delays or any other technical difficulties beyond our control.

4. Privacy Policy

1. We are committed to protecting the privacy of members of the Programme and to using their personal information in accordance with applicable data protection laws and regulations, in particular the Personal Data Act (1998:204) (“PUL”) and its implementing ordinance. When you take part in the Programme, we will collect certain personal information from you, including your name, e-mail address, country of residence and any other information you provide, such as zip code, telephone number, age group, interests and preferences. We (Hede Fashion Outlet AB) and Via Manco (UK) Limited (company registered number: 08686315) with registered address 20 Air Street, London, W1B 5AN), will act as joint controllers of the database. You are hereby informed about such handover of your personal data and you provide and accept it.

2. We will use the collected information to:
a. register you as a member of the Programme;
b. provide you with details of Offers and enable you to redeem Offers with Participating Retailers;
c. to provide you with information about events, special offers, promotions and other matters relevant to the Centre;
d. send you newsletters about informing you of goods, services, promotions, offers and forthcoming events which we consider may be of interest to you;
e. collect statistics about your use of the Programme, information on your preferences and track your spend;
f. contact you about our new developments, services and any other information we think may be of interest to you based on your use of the Programme;
g. to conduct surveys or focus groups for research analysis;
h. pass information you provide us on to companies within our group of companies so that they can contact you with details of developments and activities which may interest you.
3. We may pass on or allow access to your information:
a. to our suppliers, contractors and professional advisors where this is necessary for them to provide services and facilities to us;
b. to any purchaser of all or part of our business;
c. where we are required to do so by law, court order or other legal process;
d. where, acting in good faith, we believe disclosure is necessary to assist in the investigation or reporting of suspected illegal or other wrongful activity;
e. to protect and defend our rights or property.

4. If you consented to receive marketing information from us, you may withdraw your consent at any time by emailing us at marketing.hede@viaoutlets.com  

5. You may request a copy of the personal data which we hold about you. You can request this information by contacting us at privacy.hede@viaoutlets.com  Should we have provided you with such copy within the last twelve months prior to your request, we may levy a small charge for providing the information again, unless you prove that your request is based on a legitimate interest.

6. If you think any of the information we hold about you is out of date or incorrect, you may ask us to correct or remove this information, contact us at privacy.hede@viaoutlets.com 

7. It is possible that personal data we collect from you may be transferred, stored and/or processed outside the European Union (“EU”) and/or the European Economic Area (“EEA”). By submitting your personal data, you agree to this transfer, storing and/or processing. You should be aware that countries outside the EU/EEA may not offer the same level of data protection as Sweden, however we will take all reasonable steps to ensure that your data is treated securely and in accordance with this privacy policy and applicable data protection laws and regulations.

8. We will store the information collected no longer than necessary for the purposes of the Programme. If your membership is terminated by us or if you withdraw from the Programme by sending us a letter or an email, we will immediately delete or anonymize the personal information collected in connection with the Programme. In addition, we will delete or anonymize such information if you do not use your HFC Card for a continuous period of five years.

5. Changes to the Programme and these Terms

From time to time, we may make changes to these Terms in the following circumstances: (i) when required to comply with applicable regulation, (ii) when said changes are a consequence of any technological or technical advance or are made to introduce new functionalities, (iii) when the change is to the benefit or in the interest of members of the Programme, or (iv) in case of VIA Outlets reorganisation. Where this happens, we will notify members of the Programme with a notice on our website and we will notify you also by e mail. In case you keep using your HFC Card/App, your acceptance of the changes is deemed confirmed.

7. Applicable law and Jurisdiction

These Terms are subject to Swedish law without reference to its conflicts of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded. Any disputes, controversy or claim arising out of or in relation to these Terms and/or the Programme shall be subject to the jurisdiction of the courts of Sweden.
